Our site, products and services are owned and operated by Mindful Somatics or www.mindfulsomatics.co (“Company”, “we”, or “us”). The term “you” refers to any client or user of our site, products and services. We reserve the right to change this Terms of Service at any time. 

By using this site you are agreeing to the Terms of Service as they appear and are legally bound to them. All of the content created on this site or distributed, products and services are owned by us. You may not make copies, share, steal, duplicate, trade, distribute or perform any unauthorised activity dictated by us with this site, products, and services from this site or our associated materials. Any request to use our site, products, and materials must submitted to us in writing before with an approved written response.

Our site, products and services are intended exclusively for those who are eighteen years of age or older. We will take all necessary steps to delete personal information of those under the age of eighteen.

When you purchase any of our products or services, we may collect personal information including but not limited to your name, e-mail address, phone number, billing information, relevant health or demographic information, or any other relevant confidential information necessary for your services. This personal information is kept confidential in accordance with appropriate legislation both online and offline. By providing us with this information, you grant us permission to use and store it with respect to appropriate legislation until a time it is necessary or required by law to be destroyed. Submitting any confidential information online cannot be fully protected by us due to the nature of the internet, do so with discretion and at your own risk. We will do our best to keep this information secure.

Our site, products and services are for informational and educational purposes only, they are not to be perceived as medical advice or diagnosis or to be substituted with any appropriate medical professional at any point. We do not provide health care or the attempt to diagnose, treat, prevent or cure any condition. You acknowledge and agree that we are not liable for any damages related to the purchase or participation of our site, products, and services. 

We make no warranty to our site, products and services. We do our best to make sure our site, products, and services remain available without error but we cannot guarantee this. 

We will not be responsible or liable in any way for our site, products and services that you purchase or receive and we will not assume liability for any damages, we assume no responsibility. You acknowledge and release us from any and all claims.

You acknowledge and agree to this Terms of Service by using the site, products and services even if you have not read this document. You may only use the site, products and services in accordance with appropriate laws, ethics, and as dictated by our Terms of Service.

We hope that you will be satisfied with your experience with our site, products and services. However, due to the time and effort contributed to the development of our products and services we have a no refund policy. You remain fully responsible for the complete payment of all products and services, even if you decide to conclude your services upon completion of payments. We reserve the right to cease your access immediately and permanently if your payments are not up to date or if any illegal, abusive or unethical behaviour has occurred. In the case of illegal and abusive activity, we have the right to permanently cease your access to our site, products and services without refund. 

All personal information obtained or given during your purchases or transactions for our site, products and services, may be collected by both us and our payment processing company. Please refer below to our privacy policy for more information on how your personal information may be collected or stored. Payment processing companies may have different privacy policies than we do, please refer to them as we are not responsible for their policies. 

You may cancel or cease services at any time. You will have 48 hours after cancellation of services to pay any remaining or unpaid balances that are owed. 

In the event of a legal dispute, we agree to enter into arbitration within 1 year of a written request via email to bf@mindfulsomatics.co if you are requesting a partial or full refund of services. We agree that this arbitration will take place where my business is physically located and the decision of the arbitrator is final and binding. You also agree the prevailing party will be entitled to all fees and costs associated with the decision of the arbitrator. Even in the event of a dispute, you agree not to engage in any public conduct, which disparages us, our company, site, products and services.

The terms “we”, “us” and “our” refer to Mindful Somatics or www.mindfulsomatics.co The terms “user,” “you” and “your” refer to site visitors or users and clients.

The term “personal information” is defined as information you voluntarily provide to us which personally identifies you or your contact information, such as your name, phone number and email address.

We request and record various personal and confidential information to understand your needs and provide you with comprehensive and catered services. We will use and store this information in accordance with appropriate legislation unless it is legally required to be destroyed. All of this information, whether online or offline is protected and only accessed by your practitioner or those who help manage that information including third party payment systems or third party platforms you use to contact us such as social media. However, we do not disclose or sell information to third parties unless we are required to do so by law, to comply with any legal or physical safety concerns of you or another person, in the event we are acquired by a third party, if you request us to, or for the operation of our site and business with trusted third parties who provide support.

We are committed to protecting your online privacy. We provide a website where you can read information about our products and services, and contact us to schedule sessions. This privacy policy applies to all site visitors and clients, by using our site you agree to this policy.

In accordance with the GDPR, your personal information will only be used for the purpose which it was collected. We may collect a variety of personal information from you online and offline this includes: 

• Your name, address, phone number, email address, payment information via third party systems. We do not store payment information on Mindful Somatics servers or records. 

• Your name, gender, age, date of birth, ethnicity, religious or spiritual beliefs, health information, etc.

• We may record information relating to your use of the site or use cookies in order to improve the quality of our site. You can delete cookies at any time or change the privacy settings on your browser. We may share your information with trusted third parties who will assist us in operating our site or conducting our business. Any of these third parties also agree to keep your information confidential. 

Our site may contain links to third party websites, we are not responsible for the privacy policies of other sites. Our servers are located in the United States.

We will do everything we can to ensure the protection of your information online, through our site and platforms. You acknowledge and agree that we are not responsible for any interception of information without our permission or awareness. Please be cautious with any information you share publicly relating to our site. 

Children under the age of eighteen are prohibited from using our site and services, we will do our best to erase any information unknowingly collected of minors.
